Welcome to HERDES. Please read these Terms carefully before placing an order. They govern your use of our online shop and form the contract between you and us.

These Terms apply to all orders placed via the HERDES online shop at www.herdes.eu by consumers and businesses. The website and shop are operated by WELOVEPAPER S.L., trading as HERDES (CIF B66790254). Spanish law applies together with mandatory EU consumer protection rules.

2. Products and Descriptions

We offer HERDES publications and third‑party publications, art prints and decorative posters, and branded merchandise such as tote bags and accessories. We endeavour to describe products accurately; minor variations in colour, paper stock, format or finish may occur due to printing or screen display.

3. Ordering Process and Contract Formation

Placing items in your basket does not constitute a binding offer. By clicking “Place order”, you submit a binding offer to purchase the items in your basket. We will confirm receipt by email; this acknowledgement is not acceptance. The contract is concluded when we dispatch the goods and send you a shipment confirmation, or, in the case of advance payment, when we confirm acceptance of your order.

4. Pre‑Orders and Limited Editions

Pre‑order items are charged at the time of purchase and will ship when available. Estimated dispatch dates are indicative only. For limited editions and art prints, availability is not guaranteed until shipment confirmation. If an item cannot be fulfilled, we will refund you in full using the original payment method.

5. Prices, Taxes and Duties

Prices are shown in euros and include Spanish VAT (IVA) where applicable. For deliveries outside the EU, local taxes, customs duties and clearance fees may be charged by the destination country; such charges are payable by the customer.

6. Payment Methods

We accept payment by credit/debit card (Visa, MasterCard, American Express) via Stripe, PayPal, and bank transfer. Transactions are processed in accordance with PSD2 strong customer authentication. Ownership of goods transfers only after full payment.

7. Delivery, Risk and Title

Delivery timelines and fees are detailed in our Delivery & Returns Policy. Title to the goods remains with HERDES until full payment has been received. Risk passes to you upon delivery to the address provided.

8. Right of Withdrawal (Consumers in the EU/EEA)

Subject to statutory exceptions, EU/EEA consumers have a 14‑day right to withdraw from distance contracts. However, the right of withdrawal does not apply to (i) the supply of newspapers, periodicals or magazines, except for subscription contracts; (ii) goods made to the consumer’s specifications or clearly personalised (e.g., custom‑framed or personalised art prints); and (iii) sealed goods which are not suitable for return due to health protection or hygiene reasons once unsealed. 9. Defects and Warranty

If your item is defective or damaged on arrival, please notify us within 7 days with photographs of the product and packaging. Statutory warranty rights apply under Spanish law.

10. Account Registration and Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and restricting access to your account. Please inform us immediately of any unauthorised use.

11. Intellectual Property

All content on the website, including texts, images, graphics, logos and layouts, is protected by intellectual property laws. You may not reproduce, distribute or create derivative works without our prior written consent or the consent of the relevant rights holder.

12. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of slight negligence, we are liable only for breach of material contractual obligations and limited to foreseeable, typical damages. Nothing in these Terms affects your statutory consumer rights.

13. Online Dispute Resolution

In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in consumer arbitration proceedings.

14. Governing Law and Jurisdiction

These Terms are governed by Spanish law, without prejudice to mandatory consumer protection rules in your country of residence. Exclusive jurisdiction lies with the courts of Barcelona, Spain, unless otherwise required by consumer law.

15. Severability

If any provision of these Terms is or becomes invalid, the remaining provisions shall remain in force. The invalid provision will be replaced by a valid one that most closely reflects the original economic intent.
